The count is 0-2 on Trump as US District Judge Derrick K. Watson delivered another curve ball, and No. 45 is wildly swinging at everything.

The Hawaiian judge halted Trump’s new ban hours before it was to take effect. Watson pointed out in a scorching argument against the executive order that it was discriminatory and it wouldn’t be hard to prove his polished directive is still very much a violation of the US Constitution. He stated that just because the order was not directed at all Muslim countries, it didn’t make it any the less discriminatory.

“The illogic of the Government’s contentions is palpable,” the judge stated, “The notion that one can demonstrate animus toward any group of people only by targeting all of them at once is fundamentally flawed.”

As Trump and those who supported the ban sought to defend it, they actually made their case weaker by saying things like, there are only minor technical differences, and as Stephen Miller put it during a Fox News appearance, it’s the “same basic policy outcome for the country.”

Trump will likely take to Twitter later tonight or early in the morning, if he follows his usual MO, to insult the judges who seem to see clearly what he does not.

Judges in Washington State and Maryland are expected to deliver their statements on Trump’s new travel ban soon.
