Some from the Republican ranks are advising the President to withdraw Secretary of Labor nominee Andrew Puzder because he lacks the votes necessary for confirmation.

The fast-food executive has been under fire over by Democrats for his stand on the minimum wage and other labor issues, and it’s been reported that Puzder hired an undocumented immigrant worker and did not pay taxes for her.

Puzder has also been fighting alleged abuse claims by his former wife, and It’s been noted that he apprenticed under a mob lawyer early in his career. This would be the first Trump nominee denied confirmation.

UPDATE: Andrew Puzder withdrew his name from consideration for Labor Secretary.
